Privacy Policy

This Privacy Policy explains how TERMA Mechanical Contractors, LLC ("TERMA", "we", "us") processes personal data when you visit this website, contact us or subscribe to our updates. We process personal data in line with the Turkish Personal Data Protection Law No. 6698 (PDPL) and, where it applies, the EU General Data Protection Regulation (GDPR).

1. Who is responsible for your data

2. What data we collect

  • Contact form: your name, email address, company and the content of your message, and optionally your phone number, the project location and the service you need.
  • Newsletter: your email address and language preference.
  • Technical data: when you visit the site, our hosting provider automatically records server logs such as your IP address, browser type, the page requested and the time of the request.
  • Bot protection: when you use a form, Cloudflare Turnstile checks that it is being filled in by a person, using technical signals such as your IP address and browser information.

We do not use advertising or analytics cookies, and we do not ask for special categories of personal data. Please do not include such information, for example health data, in your messages.

3. Why we use it and on what legal basis

  • To answer your enquiry and prepare proposals you request: steps prior to a contract and our legitimate interest in responding (PDPL Art. 5(2)(c) and (f); GDPR Art. 6(1)(b) and (f)).
  • To send the updates you subscribed to: your explicit consent (PDPL Art. 5(1); GDPR Art. 6(1)(a)), which you can withdraw at any time.
  • To operate, secure and troubleshoot the website: our legitimate interest (PDPL Art. 5(2)(f); GDPR Art. 6(1)(f)).
  • To comply with legal obligations and to establish, exercise or defend legal claims (PDPL Art. 5(2)(ç) and (e); GDPR Art. 6(1)(c) and (f)).

4. Who we share it with

We do not sell personal data. We share it only with service providers that help us run this website, under contracts that require them to protect it:

  • Hosting: Vercel Inc. (United States), which serves the website and keeps server logs.
  • Email: Çizgi Telekomünikasyon A.Ş. (Ofis.net, Türkiye), which hosts our company mailbox and delivers contact form messages and newsletter sign-ups to it.
  • Bot protection: Cloudflare, Inc. (United States), whose Turnstile service checks form submissions for automated abuse.

We may also disclose data to public authorities when the law requires it, and to our professional advisers when needed to protect our rights.

5. International transfers

Our service providers may process data outside Türkiye and the European Economic Area, including in the United States. Where this happens we rely on the safeguards required by law, such as standard contracts under Article 9 of the PDPL and standard contractual clauses under Chapter V of the GDPR.

6. How long we keep it

  • Enquiries: as long as needed to handle your request and any resulting business relationship, and afterwards for the periods required by law or the limitation period of possible legal claims.
  • Newsletter: until you unsubscribe or ask us to delete your data.
  • Server logs: for the short period set by our hosting provider for security and troubleshooting.

When data is no longer needed, it is deleted, destroyed or anonymised.

7. Your rights

Depending on the law that applies to you, you have the right to:

  • learn whether we process your personal data, receive information about it and obtain a copy;
  • learn the purpose of processing, whether it is used for that purpose, and the third parties in Türkiye or abroad to whom it is transferred;
  • have inaccurate or incomplete data corrected, and have these corrections notified to the third parties who received it;
  • have your data erased, destroyed or its processing restricted;
  • receive your data in a portable format (GDPR);
  • object to processing based on our legitimate interests, and to results against you arising solely from automated analysis;
  • withdraw your consent at any time, without affecting processing carried out before;
  • claim compensation for damage caused by unlawful processing.

To exercise these rights, write to info@termaisi.com.tr or to our postal address. We will answer within 30 days at the latest. You may also lodge a complaint with the Turkish Personal Data Protection Authority or with the data protection authority of your EU country of residence.

8. Security

We use appropriate technical and organisational measures, including encrypted (HTTPS) connections and restricted access to our mailboxes, to protect personal data against loss, misuse and unauthorised access.

9. Children

This website is intended for business users. We do not knowingly collect personal data from children.

10. Changes to this policy

We may update this policy when our website or the law changes. The date at the top of this page shows when it was last updated.
